. jeff, first to you, once the supreme court makes that final decision in the spring, maybe by june at the end of the term, we will know whether or not same sex marriage will be legal, not only in those states like new york state or maryland or iowa where it is legal, but throughout the united states. >> it is a possibility, there are limited possibilities. the court specifically took nose in this case, whether the question of whether the people defending the law in california even have the right to be in court. do they have standing. they could simply rule that the people defending the law don't have standing. that wouldn't even deal with the issue of the constitutionality of same sex marriage. that would be a procedural ruling that would allow the court to duck the issue of is there a constitutional right for gay people to get married. so it's a possility that all 50 states could be ordered to have same sex marriage, but it's also a possibility that the court could duck that issue all together. >> obviously we have to wait to see what the nine justices decide. gloria, you've done

. gin me as former fbi agent jeff lanza, we want to point out he is no relation to adam lanza. security was tight at this school in connecticut. but the gunman was able to get in any way. apparently shooting his way in. is there any way to stop that? >> no place is 100% safe. schools have been in lockdown mode since columbine in terms of the locks and doors they have, buzz-in procedures. that's very important and probably resulted in a lot of people not getting hurt but the problem is, they are never 100% safe. use a gun to break open windows, break open windows other ways, get your hand in and open the door. that's what happened here. no place is 100% secure. >> what about the guns? handguns were found in the school. a rifle in his car. can stronger restrictions on guns prevent these shootings? this opens up the whole gun control debate. where do you stand on that? >> you know, i think -- uncan't make the deaths of these children and the adults to have -- to have less meaning or no meaning at all. it needs to be a legacy and the legacy is congress and the highest levels of government,

about culture and mental health. there's a lot of things to take years. >> jeff, weigh in on this. i thought -- i was kind of surprised how specific the president was when he talked about the things he's pushing forward. the assault weapons ban and a limit on high-capacity ammunitions and a background check for all gun purchases. what kind of position is he in to push this forward? there's been so little political will on either side to do any of that. >> i was struck how he said, joe biden is the perfect person to do this, because biden was the person who led the assault weapons ban fight in congress in 1994. that's certainly true. it is also true that that crime bill and particularly the assault weapons ban was considered a political disaster for the democratic party, especially for the democrats in the south and in the west who were really wiped out in the 1994 midterm elections. so, yes, it is true biden has the expertise, but he knows what a political risk it is for democrats like, for example, kay hagen, who is running for re-election in north carolina. let's see what she think

to do is register every gun. next call comes from jeff in texas, republican line. caller: back when i was a teenager, i did something stupid and got a felony charge. i am 45 years old now. they still hold that against me. i am bowhunting because i am still not allowed to own a gun. is there ever going to be a statute of limitations on a felony convicted by a kid as to ever be able to purchase a gun? guest: this is a problem that we hear quite a bit. people have completely reformed themselves after committing crimes, but are nonetheless unable to get them. there is a system in place in most states where by the governor can grant a waiver to put you back into the pool of people that are able to obtain firearms. that is hard to do and would be costly and involve lawyers. it is difficult. this is one of the issues with the system. when the brady act was written in 1993 and when the gun control act of 1968 was put in place, it initially traded a class of people who were not allowed to own guns. they had to draw the line somewhere. it is a problem for folks like you have that have reform th
